Legal — Terms of service

These terms govern your use of this website. They are short because their scope is narrow.

Client work is governed separately
Any engagement — infrastructure work, product work or commissioned work — is governed by a separate written agreement signed by both parties. That agreement sets the scope, the deliverables, the fees, the ownership of what is built and the terms of termination.
Nothing on this page overrides, limits or supplements that agreement. Where these terms and a signed agreement conflict, the signed agreement prevails in full. Descriptions of how work is scoped, priced or delivered elsewhere on this site are explanatory and are not contractual terms.
03
Site content and marks
The text, layout, design and code of this site, together with the Specus name and logo, remain the property of the operator or its licensors. You may read, quote and link to this site as you would any published page.
You may not reproduce the site substantially as a whole, present its content as your own, or use the Specus name or logo in a way that suggests endorsement, partnership or affiliation that does not exist. The logo may not be altered, redrawn or recoloured.
04
Information is provided without warranty
The information on this site is provided in good faith and is believed accurate when written, but it is provided without warranty as to accuracy, completeness or fitness for any particular purpose. Technical descriptions may become outdated as products change.
Nothing here is technical, legal or professional advice, and it should not be relied on as the basis for a decision without asking us directly. The site may be unavailable, incomplete or changed at any time without notice.
05
Third-party links
Where this site links to a third party, that link is for reference. The content, availability and privacy practices of external sites are outside our control and are not endorsed by the presence of a link. Once you follow one, that site’s own terms and privacy policy apply.
06
Limitation of liability
To the extent permitted by law, we are not liable for any loss arising from your use of, or inability to use, this website — including loss of profit, loss of data or any indirect or consequential loss.
This limitation applies only to this website. It does not affect liability under a signed client agreement, and it does not exclude or limit any liability that cannot lawfully be excluded — including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or any statutory right you have as a consumer.
07
Governing law and jurisdiction
The operator is established in Câmara de Lobos, Madeira, Portugal. Portuguese law governs these website terms.
If you are a consumer, this choice of law cannot take away the protection of mandatory provisions of the law that would apply without that choice. This includes the law of the country where you habitually reside when Article 6 of Regulation (EC) No 593/2008 (Rome I) applies.
The competent court is determined by the applicable Portuguese procedural law and EU or international jurisdiction rules, including Regulation (EU) No 1215/2012 (Brussels I bis) where it applies. These terms do not establish an exclusive choice of court.
Where the consumer jurisdiction rules in Articles 17 to 19 of that Regulation apply, you may bring proceedings against the operator in Portugal or before the courts for the place where you are domiciled. The operator may generally bring proceedings against you only in the Member State where you are domiciled. The exceptions and counterclaim rules in Articles 18 and 19 remain applicable.
08
How these terms change
These terms may be updated. The version in force is the one published here, dated at the top of the page. Continuing to use the site after a change means the updated terms apply to that use. Changes are not applied retrospectively, and they never alter a signed client agreement.
